- In most cases the lender is within their rights to commence with a foreclosure. This assumes the brorrwer has missed a series of payments. or otherwise failed to comply with some other provisions of the note or loan agreement. But we at NLS understand that there are times a lender is in the wrong. Perhaps it's the assignor and not the assignee or succesor who comitted the errors or ommissions. If a lender makes a mistake in the documents, a court may throw out the whole foreclosure case.
