The “People’s Court”. Depending on where you live, this component of our judiciary is called the Magistrate Court, the Civil Court, Special Civil Court, the District Court, or Special Parts of the Superior Court. Regardless of what it is called, it is where millions of people go annually to resolve legal disputes.
Although many people will hire lawyers to represent them in a legal matter, on a state-by-state basis, hundreds of thousands will annually enter the “People’s” or “Small Claims” Court and represent themselves. If this statement creates a vision of a Judge Wopner or Judge Judy, both made famous by commercial television, you have the wrong picture. Judges at this level are professional, compassionate, encouraging and patient! They recognize their role is to assist the public in resolving legal “disputes”, not to make people feel bad or inadequate.
However, no matter how pleasant the Judge and staff, the process is not convenient. Typically, you have to take time from work to travel to the Courthouse, obtain the Court documents necessary to file your case, complete them and physically deliver them to the County Clerk for payment and processing. And that’s before you have to take more time away from work or family to personally appear before the Judge. In some jurisdictions, mediation is a mandatory step, thus requiring more time away from your normal schedule.
